The practice of the consensus-based re-surname system between spouses is not prohibited according to the China's Marriage Law.The stipulation shall be abolished with the reasons as thefollowing:(1) Wives in the ancient China would be formally addressed as Ms X(X stands for the surname of her husband),for the inequality of the legal status between man and woman in the family and also for the improvement of the administrative efficiency.(2)Although theconsesus-based re-surname system would contribute to the promotion of die legal equality between man and woman,the practice in the developed countries have proved otherwise,it doesn t result in the equality between man and woman in real term.(3) If this right is exercised by spouses,it would have the detrimental effect on the country, spouses and cultural mentality.(4) It is required that the spouses shall retain their original surname in the France, Quebec in the Canada,Belgium,Holland,and the State of Louisiana in U.S.A.
